Member States and hosting service providers, in respect of content provided by content providers which they store at the request of those content providers, are encouraged to take effective, appropriate and proportionate measures to tackle illegal content online, in accordance with the principles set out in this Recommendation and in full compliance with the Charter, in particular the right to freedom of expression and information, and other applicable provisions of Union law, in particular as regards the protection of personal data, competition and electronic commerce.
